1. Who We Are
Neura.Day ("we", "us", "Neura.Day") operates the website neura.day and provides an AI health companion service via WhatsApp designed to help people living with Parkinson's disease track symptoms, manage medications, follow therapy protocols, and access daily research updates.
By using the Service you ("user", "subscriber") agree to these Terms of Service ("Terms") and our Privacy Policy, which is incorporated by reference.
2. Important Medical Disclaimer
THE SERVICE IS NOT A MEDICAL DEVICE, MEDICAL TREATMENT, OR SUBSTITUTE FOR PROFESSIONAL MEDICAL ADVICE.
- Neura.Day is a wellness information and tracking tool only. Nothing the AI companion says constitutes medical advice, a diagnosis, a prescription, or a treatment recommendation.
- Always consult a qualified healthcare professional — including your neurologist, GP, physiotherapist, or pharmacist — before making health decisions.
- Do not delay seeking professional medical advice or modify your medication based on anything the AI companion tells you.
- In an emergency, call your local emergency services immediately. Neura.Day is not designed for emergency use.
- The Dr Constantini B1 Thiamine therapy tracking module is an informational tracking tool only. We make no claims about the efficacy of any therapy or supplement.
3. Eligibility
- You must be at least 18 years old to use the Service.
- You confirm you have the legal capacity to enter a binding agreement under the laws of your jurisdiction.
- If using the Service as a caregiver on behalf of another person, you confirm you have authority to accept these Terms on their behalf and that they are aware of and consent to your use.
4. Accounts and Registration
- You must create an account using a valid email address and are responsible for maintaining confidentiality of your credentials.
- You agree to provide accurate, current, and complete information and keep it up to date.
- You are responsible for all activity under your account. Notify us immediately at hello@neura.day if you suspect unauthorised access.
- We may suspend or terminate your account for breach of these Terms, inaccurate information, or suspected fraud.
5. Subscription and Payment
- The Service is offered on a monthly subscription at the price displayed at sign-up (currently $9/month in USD).
- Your subscription renews automatically each month unless cancelled before the renewal date.
- Payments are processed by Stripe, Inc. By subscribing, you authorise recurring monthly charges to your payment method.
- We may retry failed payments up to three times before suspending access.
- Price changes will be communicated with at least 30 days' notice by email. Continued use after the effective date constitutes acceptance of the new price.
- Fees are exclusive of applicable taxes (VAT, GST, etc.) which may be added depending on your location.
6. Free Guide and Lead Capture
- By submitting your email for our free guide, you consent to receiving the guide and occasional service-related communications.
- You may unsubscribe at any time via the unsubscribe link in any email or by contacting hello@neura.day.
- The Guide is provided for informational purposes only and does not constitute medical advice.
7. Cancellation and Refunds
- You may cancel your subscription at any time via your account settings or by contacting hello@neura.day. Access continues until the end of your billing period.
- We do not offer refunds for partial months except where required by applicable consumer protection law.
- Report billing errors within 30 days to hello@neura.day and we will investigate promptly.
8. Use of the Service
You may use the Service solely for personal, non-commercial health tracking and wellness purposes. You agree not to:
- Use the Service unlawfully or in violation of any applicable law.
- Attempt to gain unauthorised access to any part of the Service or other users' accounts.
- Reverse engineer, decompile, or attempt to extract source code.
- Use bots, scrapers, or automated tools without our written consent.
- Misrepresent your identity or impersonate others.
- Upload harmful, defamatory, or infringing content.
- Resell, sublicense, or commercially exploit the Service or its data.
- Share your credentials with third parties other than authorised caregivers within the service.
Use via WhatsApp is additionally subject to Meta's Terms of Service. We are not responsible for WhatsApp availability or policies.
9. Health Data and Wearable Integrations
- By connecting third-party devices (Garmin, Apple Health, Oura, etc.), you grant us permission to access and process that data as described in our Privacy Policy.
- You are responsible for ensuring you have the rights to share connected device data with us.
- We are not responsible for the accuracy of data provided by third-party wearables. Consumer wearable metrics are estimates, not clinical measurements.
10. Caregiver Access
- If you grant caregiver access to another person, you confirm you have obtained the relevant person's consent.
- Caregivers must not share health data with third parties without explicit consent.
- You may revoke caregiver access at any time from your account settings.
11. Intellectual Property
- All intellectual property in the Service — including design, software, AI models, and content — belongs to Neura.Day and its licensors.
- We grant you a limited, non-exclusive, revocable licence to use the Service for personal purposes. This licence ends on cancellation or termination.
- You retain ownership of personal data you submit. By submitting it, you grant us a limited licence to process it solely to provide and improve the Service.
- "Neura.Day" and "neura.day" are our trademarks and may not be used without prior written consent.
12. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT:
- The Service will be uninterrupted, error-free, or secure.
- Health information, insights, or research summaries will be accurate, complete, or current.
- The Service will meet your specific health or medical needs.
- Any therapy, supplement, or protocol mentioned will be effective for your situation.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NEURA.DAY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING PERSONAL INJURY, HEALTH OUTCOMES, LOSS OF DATA, OR LOSS OF PROFITS — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50 USD.
14. Indemnification
You agree to indemnify, defend, and hold harmless Neura.Day and its team from any claims, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, breach of these Terms, or violation of any applicable law or third-party rights.
15. Third-Party Services
The Service integrates with third-party platforms (WhatsApp, Garmin, Apple, Oura, Stripe, Brevo, and others). We are not responsible for their content, availability, or privacy practices. Your use of third-party services is governed by their own terms.
16. Service Availability and Modifications
- We strive for continuous availability but do not guarantee uninterrupted access.
- We may modify, suspend, or discontinue any part of the Service at any time with reasonable prior notice where practical.
17. Termination
- You may terminate at any time by cancelling your subscription.
- We may immediately suspend or terminate your access for breach of these Terms, legal obligation, risk to other users, or unresolved payment failure.
- On termination, your right to access the Service ceases. Data is handled per our Privacy Policy.
18. Governing Law and Disputes
- These Terms are governed by the laws of the jurisdiction in which Neura.Day is registered.
- We encourage you to contact hello@neura.day first to resolve disputes informally.
- EU consumers may use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.
19. Consumer Rights
Nothing in these Terms limits any statutory consumer rights that cannot be excluded by contract under the applicable laws of your country.
20. Changes to These Terms
We may update these Terms at any time. Material changes will be communicated by email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes your acceptance.
